MHTC Whistleblowing Policy & Procedure

Malaysia Healthcare Travel Council (“MHTC”) is committed to conducting its business with integrity, transparency, and accountability, in compliance with all applicable laws, including but not limited to the Whistleblower Protection Act 2010, Companies Act 2016, and Malaysian Anti-Corruption Commission Act 2009. Where multiple documents conflict on the same matter, the more stringent requirement shall apply.

Scope

This Policy applies to employees, the Board, business associates, and third parties who have business dealings with MHTC, including former employees for disclosures relating to conduct during their employment.

Confidential Reporting

MHTC provides a confidential and secure channel for anyone to report actual, suspected, or potential misconduct, malpractice, or improper conduct in good faith. The identity of the whistleblower and all reported information will be protected and disclosed only to those authorized to assess or investigate the matter, unless required by law or legal proceedings.

Limitations of Protection

Protection under this Policy may not apply if the whistleblower:

  • Participated in the improper conduct being disclosed;
  • Willfully made a material false statement in their disclosure;
  • Primarily disclosed issues questioning the merits of government policy;
  • Disclosed information solely or substantially to avoid dismissal or other disciplinary action.

Whistleblowers are encouraged to report concerns using any of the following channels:

Zero-Tolerance on Retaliation

MHTC adopts a zero-tolerance approach to retaliation or victimisation against whistleblowers acting in good faith. Any retaliatory conduct will be treated as a serious disciplinary offence.
